The Remonstration process allowed rejected applicants to submit an appeal directly to the relevant consulate or embassy without incurring additional fees or initiating formal legal proceedings. This informal appeal provided a convenient remedy, especially for Schengen and national visa applicants.
With the termination of this process, applicants worldwide—particularly a large number from India, including students, skilled workers, and tourists—will lose this relatively fast and low-cost route for contesting visa denials. Previously, Indian applicants could use the Remonstration to request a reconsideration of their rejected visa applications, sometimes avoiding lengthy and costly legal battles. Going forward, these applicants will have to either reapply for the visa or file formal legal challenges in German courts, which typically require more time and financial resources.
According to German statistics from 2024, there were 206,733 Schengen visa rejections that year, with a refusal rate of 13.7%. This change is expected to make it more difficult for applicants from countries like India to navigate visa refusals, resulting in longer processing times and increased costs. Although applicants retain their right to judicial review through the courts, this route often poses a heavier burden for those with limited financial means.
The German government emphasizes that this move aims to improve the transparency and efficiency of visa decisions while reducing the resource waste caused by repeated reviews. Experts suggest that eliminating the informal appeal process may encourage applicants to prepare their documentation more carefully but could also limit accessible recourse for some eligible applicants.
