What Is The EB-3 Process

The EB-3 visa is a popular choice for foreign workers seeking to immigrate to the United States. It is designed for skilled workers, professionals, and unskilled workers. This article explores the EB-3 process in detail. It covers eligibility requirements, application steps, and important considerations.

What is the EB-3 Visa?

The EB-3 visa is an employment-based immigrant visa. It allows foreign nationals to live and work permanently in the U.S. There are three main categories within the EB-3 visa:

Skilled Workers: This category is for individuals with at least two years of job experience or training.

Professionals: This category is for individuals with a U.S. bachelor’s degree or its foreign equivalent.

Unskilled Workers: This category is for individuals performing unskilled labor. The work must be permanent and non-seasonal.

Eligibility Requirements

To qualify for an EB-3 visa, applicants must meet specific eligibility criteria. First, they need a job offer from a U.S. employer. The job must require at least two years of training or experience, depending on the category.

For skilled workers, the applicant must have the necessary qualifications. This includes education and experience related to the job. For professionals, a bachelor’s degree is essential. It should be in a field related to the offered position.

Unskilled workers must prove that they can perform the job. The position should require less than two years of experience. The employer must also demonstrate a need for the worker.

The Labor Certification Process

One of the key steps in the EB-3 process is obtaining a labor certification. This certification shows that there are no qualified U.S. workers available for the job. The U.S. employer must file a petition with the Department of Labor (DOL) to receive this certification.

The process begins with a recruitment effort. The employer must advertise the job to find qualified U.S. workers. If no suitable candidates are found, the employer can proceed with the labor certification application.

The DOL will review the application. If approved, the labor certification is issued. This step is crucial because it supports the EB-3 visa petition.

Filing the Petition

Once the labor certification is obtained, the next step is to file Form I-140, Immigrant Petition for Alien Worker. The employer must submit this form to U.S. Citizenship and Immigration Services (USCIS). This form demonstrates that the applicant meets the qualifications for the job.

Along with Form I-140, the employer must include supporting documents. This may include:

The approved labor certification

Evidence of the applicant’s qualifications

Proof of the employer’s ability to pay the offered wage

After submitting the petition, USCIS will review it. If everything is in order, they will approve the petition.

Adjustment of Status or Consular Processing

After the I-140 petition is approved, the next step depends on whether the applicant is in the U.S. or abroad. If the applicant is in the U.S., they may apply for an Adjustment of Status using Form I-485. This allows them to change their status to a lawful permanent resident.

If the applicant is outside the U.S., they must go through consular processing. This involves applying for an immigrant visa at a U.S. embassy or consulate in their home country. The process includes an interview and submitting additional documentation.

Important Considerations

Several factors can impact the EB-3 process. First, the visa category has limited annual quotas. This means that waiting times can vary. For certain countries, the wait can be longer due to high demand. It’s essential for applicants to stay informed about visa bulletin updates.

Another consideration is the ability of the employer to maintain the job offer. If the employer withdraws the job offer after the petition is filed, the process may be affected. The applicant should ensure that the job remains available throughout the process.
