What Is The EB-5 Property Investment

The EB-5 Immigrant Investor Program offers a unique opportunity for foreign nationals to obtain U.S. residency through property investment. This program was established to stimulate the U.S. economy by attracting foreign investment. Investors who contribute to a new commercial enterprise can secure a Green Card for themselves and their immediate family members.

What is the EB-5 Program?

The EB-5 program was created by Congress in 1990. It allows foreign investors to obtain permanent residency in the U.S. by investing in a new commercial enterprise. The minimum investment amount is $1.05 million. However, if the investment is made in a targeted employment area (TEA), the minimum requirement is reduced to $800,000.

A TEA is defined as an area with high unemployment or a rural location. This program aims to encourage economic growth in these regions.

The EB-5 program also requires that the investment creates or preserves at least ten full-time jobs for U.S. workers.

Step 2: Make the Investment

Once a project is selected, the investor must make the required investment amount. This can be done through various financing methods, including cash, loans, or a combination of both.

Step 3: Submit Form I-526

After making the investment, the next step is to file Form I-526, Immigrant Petition by Alien Investor. This form demonstrates that the investor’s funds are from a lawful source and that the investment meets the EB-5 program requirements.

Step 4: Obtain Conditional Green Card

If the I-526 petition is approved, the investor and their family members will receive a conditional Green Card. This card is valid for two years. During this period, the investor must ensure that the project meets job creation and investment requirements.

Step 5: File Form I-829

Within 90 days before the two-year anniversary of the conditional Green Card, the investor must file Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status. This form verifies that the investment has met the job creation requirement and that the investment is still at risk.

Step 6: Receive Permanent Green Card

If the I-829 petition is approved, the conditions on the Green Card will be removed. The investor and their family will then become lawful permanent residents of the U.S.
