Legal Permanent Resident of the United States: Rights and Responsibilities

by Celia

in Immigration, immigration policy

A legal permanent resident of the United States, often referred to as a “green card holder,” is an individual who has been granted the legal right to live and work in the United States on a permanent basis. While legal permanent residents enjoy many of the rights and privileges of US citizens, they are not the same. In this article, we will explore what it means to be a legal permanent resident of the United States, including their rights, responsibilities, and how they differ from US citizens.

Rights of Legal Permanent Residents

Legal permanent residents in the United States have several rights, including:

Right to Live and Work: Green card holders can live and work in the United States indefinitely, with almost no restrictions on their employment opportunities.

Right to Travel: Legal permanent residents can travel freely in and out of the United States, although they must maintain their residence in the country.

Right to Own Property: Green card holders can own property in the United States, including homes and businesses.

Access to Education and Healthcare: Legal permanent residents have access to public education and certain public healthcare services.

Legal Protection: They are entitled to legal protection under US laws, with the right to pursue legal action and seek remedies in US courts.

Social Security Benefits: Some green card holders may be eligible for Social Security benefits if they have worked and paid into the system for a specific period.

Responsibilities of Legal Permanent Residents

Along with their rights, legal permanent residents also have certain responsibilities:

Tax Obligations: Green card holders are required to report their income and pay federal, state, and local taxes in the United States, just like US citizens.

Obeying Laws: Legal permanent residents must obey all federal, state, and local laws, as well as US immigration laws.

Register with the Selective Service: Male green card holders aged 18 to 26 must register with the Selective Service System, which is a requirement for all male US citizens and eligible non-citizens.

Maintaining Residence: Legal permanent residents must maintain their residence in the United States and not stay abroad for extended periods, as this can jeopardize their status.

Renewal of Green Card: Green card holders are responsible for renewing their green cards before they expire, typically every ten years.

How Legal Permanent Residents Differ from US Citizens

While legal permanent residents enjoy many rights and privileges, there are several key differences that set them apart from US citizens:

Voting Rights: Legal permanent residents cannot vote in federal elections or run for public office. These rights are reserved for US citizens.

Citizenship Benefits: US citizens have access to certain benefits and entitlements that are not available to legal permanent residents, such as eligibility for federal financial aid for education.

Deportation Risk: Legal permanent residents can face deportation if they commit certain crimes or violate immigration laws, which is not a risk for US citizens.

Citizenship: Legal permanent residents can apply for US citizenship through a process known as naturalization, which grants them full US citizenship rights.

Conclusion

Legal permanent residents of the United States play a vital role in the country’s social and economic fabric. They enjoy many of the rights and opportunities that US citizens have, but they also have certain responsibilities, such as paying taxes and obeying laws. While legal permanent residents are not US citizens, they can choose to pursue naturalization to become citizens and fully participate in the rights and privileges that come with it. Understanding the rights and responsibilities of legal permanent residents is essential for those seeking to live and work in the United States while maintaining lawful status.
