A Guide to Applying for a Spouse Open Work Permit in Canada

In this article, we will provide a step-by-step guide on how to apply for a Spouse Open Work Permit in Canada, outlining the requirements, eligibility criteria, and application process.

1. Determine Eligibility for Spouse Open Work Permit

Before applying for a Spouse Open Work Permit, it is crucial to ensure that you meet the eligibility criteria set by Immigration, Refugees and Citizenship Canada (IRCC). Generally, to qualify for a Spouse Open Work Permit, you must:

Be the spouse or common-law partner of a Canadian citizen or permanent resident who is sponsoring your application for permanent residence.
Have a valid temporary resident status in Canada (visitor, student, or worker) or be eligible to restore your status.
Submit an application for an Open Work Permit at the same time as the sponsorship application.
Provide evidence of the sponsorship application or proof that it has been submitted.

2. Prepare Required Documents

To apply for a Spouse Open Work Permit, you will need to gather and submit specific documents to support your application. These typically include:

Application Forms:

Fill out the appropriate forms, including the Application for Work Permit Made Outside Canada (Form IMM 1295) or the Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker (Form IMM 5710).

Proof of Relationship:

Include supporting documents to establish the genuineness of your relationship with your spouse or common-law partner, such as marriage certificates, joint bank account statements, lease agreements, or photographs.

Proof of Sponsorship:

Provide evidence that your Canadian spouse or partner has submitted a sponsorship application on your behalf or proof of the sponsorship approval if available.

Valid Passport and Travel Documents:

Include copies of your passport and any other travel documents used to enter Canada.

Photos: Provide recent photographs that meet IRCC’s specifications for visa applications.

Biometric Information:
