Which US visa allows spoUSe to work

Moving to the United States can be an exciting experience for people from all over the world. But, sometimes, it can also be quite challenging, especially for spouses who want to work while living in the US. In this article, we will discuss which US visa allows a spouse to work in the country.

 The H-4 Visa

The H-4 visa is a non-immigrant visa that is issued to the immediate family members of H-1B visa holders. This includes spouses and children under the age of 21. The H-1B visa is a temporary work visa that allows foreign workers to work in the United States for up to six years.

The H-4 visa allows spouses of H-1B visa holders to live in the US but previously did not allow them to work. However, on May 26, 2015, the Department of Homeland Security (DHS) issued a rule allowing certain H-4 dependent spouses to apply for employment authorization. This rule applies to spouses of H-1B visa holders who are in the process of obtaining lawful permanent resident status (Green Card).

Once the H-4 spouse receives employment authorization, they can work for any employer in the US, including self-employment.

The L-2 Visa

The L-2 visa is a non-immigrant visa issued to the immediate family members of L-1 visa holders. The L-1 visa is a temporary work visa that allows multinational companies to transfer executives, managers, and specialized knowledge workers from their foreign offices to the US.

The L-2 visa allows spouses of L-1 visa holders to live in the US. Additionally, unlike the previous version of the H-4 visa, the L-2 visa has always allowed spouses to work in the US.

Once the L-2 spouse receives employment authorization, they can work for any employer in the US, including self-employment.

The E-2 Visa

The E-2 visa is a non-immigrant visa that is available to citizens of certain countries who wish to invest a substantial amount of capital in a US business. This visa is also available to employees of the investor’s company who are essential to the US operations of the business.

The E-2 visa allows the spouse of the primary E-2 visa holder to accompany them to the US. Additionally, it also allows the spouse to work in the US without obtaining additional work authorization.

Green Card

A green card, also known as permanent residency, allows foreign nationals to live and work in the US indefinitely. Spouses of green card holders can apply for a green card themselves, which grants them permanent residency and work authorization. However, obtaining a green card can be a lengthy and complicated process. There are several ways to obtain a green card, such as through family sponsorship, employment, or refugee status.

Conclusion:

If you are a spouse of a foreign national who is planning to work in the US or already works in the US, you may be eligible for one of the visas mentioned above. The H-4 visa, L-2 visa, and E-2 visa are all options that allow spouses to accompany their partners to the US and work legally. As always, it is important to do your research and seek legal advice before applying for any visa.
