What Is The TSS Visa In Australia

The Temporary Skill Shortage (TSS) visa, also known as the subclass 482 visa, is an important part of Australia’s immigration system. It allows Australian employers to sponsor foreign workers for temporary employment in Australia when local talent is not available. This visa helps businesses fill positions in skilled occupations that are in demand.

In this article, we will explain what the TSS visa is, its different streams, eligibility criteria, and the process for applying. This information can help individuals who want to live and work in Australia temporarily, as well as employers who need skilled labor from abroad.

Overview of the TSS Visa

The TSS visa was introduced in 2018 to replace the previous Temporary Work (Skilled) visa, subclass 457. It is part of Australia’s broader effort to manage skilled migration and ensure that businesses have access to the workers they need. The visa is designed for skilled workers and allows them to stay in Australia for either short- or long-term periods, depending on the specific visa stream they apply for.

One of the key purposes of the TSS visa is to address labor shortages in specific industries. Australia has a list of skilled occupations that are eligible for sponsorship under the TSS visa. Employers can only sponsor workers for roles that appear on this list. The length of stay granted under the TSS visa depends on the occupation and stream applied for.

Different Streams of the TSS Visa

The TSS visa has three main streams:

Short-Term Stream: This stream allows workers to stay in Australia for up to two years, or up to four years if an international trade obligation applies. It is intended for occupations that are on the Short-Term Skilled Occupation List (STSOL). This stream is designed for positions that require skills that are in short supply but are expected to be filled by local workers over time. It can be renewed once, but it does not provide a pathway to permanent residency.

Medium-Term Stream: Workers on this stream can stay in Australia for up to four years. This stream is for occupations on the Medium and Long-Term Strategic Skills List (MLTSSL). It is intended for jobs that are in high demand in Australia for the long term. The medium-term stream offers the possibility of applying for permanent residency after three years.

Labor Agreement Stream: This stream is for workers who are sponsored by employers who have a labor agreement with the Australian government. Labor agreements are usually made when there are skills shortages that cannot be met through the other streams. Workers in this stream may be able to stay for up to four years and may also have the option to apply for permanent residency, depending on the terms of the agreement.

Eligibility Requirements for the TSS Visa

To be eligible for a TSS visa, both the sponsoring employer and the applicant must meet certain requirements.

For Employers

Business sponsorship: Employers must be approved by the Australian government to sponsor foreign workers. They need to demonstrate that they cannot find an Australian citizen or permanent resident with the skills required for the position.

Skilled occupation: The job being offered to the foreign worker must be on the list of eligible skilled occupations. The list is regularly updated to reflect Australia’s labor market needs.

Labor market testing: Employers must provide evidence that they have tried to hire Australian workers first. This can include advertising the position locally and providing details of any unsuccessful attempts to find a suitable candidate.

For Applicants

Skills and qualifications: Applicants must have the skills and qualifications required for the nominated occupation. In some cases, a skills assessment may be needed to prove that they meet Australian standards.

English language proficiency: Applicants must meet the English language requirements, which vary depending on the stream they are applying for. Generally, this involves taking an English test such as IELTS, TOEFL, or PTE, and achieving a specified score.

Work experience: In most cases, applicants need at least two years of relevant work experience in their occupation. This ensures that they have the necessary expertise to perform the job in Australia.

Health and character checks: All applicants must undergo a health examination and provide a police clearance to prove they meet the health and character requirements for the visa.

Application Process for the TSS Visa

The process for applying for a TSS visa involves several steps:

Employer sponsorship: First, the employer must apply to become an approved sponsor. They need to show that they are a legally operating business and have a genuine need for a foreign worker.

Nomination: Once the employer is approved as a sponsor, they need to nominate a foreign worker for the position. This involves submitting information about the job, including the job description, salary, and how it meets the requirements of the relevant skilled occupation list.

Visa application: After the nomination is approved, the foreign worker can apply for the TSS visa. They will need to provide details about their skills, work experience, English language proficiency, and other required documents.

Decision: The Department of Home Affairs will assess the application and make a decision. Processing times can vary depending on the complexity of the application and the stream being applied for.

Pathway to Permanent Residency

While the TSS visa is a temporary visa, it can provide a pathway to permanent residency for some applicants. Workers on the medium-term stream can apply for permanent residency through the Employer Nomination Scheme (ENS) or the Regional Sponsored Migration Scheme (RSMS) after three years of working in Australia.

To qualify, applicants need to meet certain requirements, such as continuing to work in their nominated occupation, being employed by their sponsoring employer, and meeting the age and English language criteria for permanent residency.

Benefits of the TSS Visa

The TSS visa offers several benefits for both employers and workers. Employers can access skilled workers from abroad to fill roles that are difficult to staff with local talent. This helps them maintain business operations and support growth.

For workers, the TSS visa provides the opportunity to live and work in Australia, gain valuable international work experience, and potentially apply for permanent residency. It also offers the flexibility to bring family members to Australia, as dependents can be included in the visa application.

Challenges of the TSS Visa

Despite its benefits, the TSS visa does have some challenges. One of the main issues is the strict labor market testing requirements, which can be time-consuming for employers. Additionally, the visa is tied to the sponsoring employer, meaning that workers may face difficulties if they want to change jobs.

Another challenge is that the short-term stream does not offer a pathway to permanent residency, which may limit its appeal to some workers. There are also concerns about the potential for exploitation of foreign workers, as the visa requires them to work for the same employer for the duration of their stay.
