What Is The Tier 2 UK Visa: A Comprehensive Guide

The Tier 2 UK visa, now known as the Skilled Worker visa, is a crucial pathway for non-European Union (EU) and non-European Economic Area (EEA) nationals seeking to work in the United Kingdom. This visa is designed for skilled workers who have been offered a job in the UK and meet specific requirements set by the Home Office. This article delves into the details of the Tier 2 visa, including its purpose, eligibility criteria, application process, and more.

What is the Tier 2 UK Visa

The Tier 2 visa was introduced to allow skilled workers from outside the UK to fill roles that could not be filled by local talent. It enables employers to sponsor individuals to come and work in the UK for a specific period. As of December 2020, the Tier 2 visa was replaced by the Skilled Worker visa, but the fundamental principles remain similar.

Eligibility Criteria

To qualify for a Tier 2 (Skilled Worker) visa, several criteria must be met. These include:

Job Offer and Sponsorship

You must have a job offer from a UK employer who is a licensed sponsor. The employer must provide you with a Certificate of Sponsorship (CoS), which is a unique reference number required for your visa application.

Skill Level

The job you are offered must be at a skill level of RQF Level 3 or above. This is roughly equivalent to A-levels or equivalent qualifications.

Salary Requirements

You must be offered a salary that meets the minimum threshold. As of the latest updates, this is typically £26,200 per year, or the going rate for the job, whichever is higher. Some occupations have different salary thresholds.

English Language Proficiency

You need to demonstrate a sufficient level of English language proficiency. This can be done by passing an approved English language test or having a degree taught in English.

Financial Requirement

You must show that you have sufficient funds to support yourself while in the UK. This generally means having at least £1,270 in your bank account, unless your employer can certify that they will provide this support.

Application Process

The application process for a Tier 2 (Skilled Worker) visa involves several steps:

Obtain a Certificate of Sponsorship

Your employer will need to issue a Certificate of Sponsorship. This certificate includes details about your job and the sponsoring employer. It is crucial for your visa application.

Gather Supporting Documents

You will need to provide various documents, including your Certificate of Sponsorship, proof of English language proficiency, evidence of financial support, and a valid passport.

Submit the Application

You can apply online through the UK government’s visa application website. You will need to pay the visa fee and the healthcare surcharge, which entitles you to access the National Health Service (NHS) in the UK.

Biometrics Appointment

As part of the application process, you may need to attend a biometric appointment to have your fingerprints and photograph taken.

Wait for a Decision

After submitting your application, you will need to wait for a decision. Processing times can vary, but most applications are processed within a few weeks.

Duration and Extension

Switching to Permanent Residency

After 5 years on a Tier 2 (Skilled Worker) visa, you may be eligible to apply for indefinite leave to remain (ILR), also known as permanent residency. To qualify, you must have lived in the UK continuously, met the salary requirements, and passed the Life in the UK Test.

Dependent Visas

Your dependents, such as a spouse or children, can apply to join you in the UK under a Tier 2 (Skilled Worker) visa. They will need to apply separately and meet specific requirements. Dependents are allowed to work or study in the UK.

Rights and Responsibilities

Employment Rights

As a Tier 2 (Skilled Worker) visa holder, you have the right to work for your sponsoring employer and, in some cases, in other roles if your visa conditions allow. You are entitled to the same employment rights as UK workers, including minimum wage and working conditions.

Responsibility to Report Changes

You must inform the Home Office of any significant changes, such as changing jobs or moving address. Your employer is also required to report certain changes to your employment status.
