Easy to Understand: What is a K-1 Visa?

The K-1 visa, commonly known as the fiancé(e) visa, is a nonimmigrant visa issued to the foreign fiancé(e) of a United States citizen. This visa allows the foreign fiancé(e) to enter the United States for the purpose of marrying their U.S. citizen sponsor within 90 days of arrival. After the marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident (LPR) of the U.S.

Purpose of the K-1 Visa

The primary purpose of the K-1 visa is to facilitate the entry of foreign fiancé(e)s into the United States for the purpose of marriage to a U.S. citizen. It is designed to allow couples to be together while completing the necessary immigration processes to establish permanent residence.

Eligibility Requirements

To qualify for a K-1 visa, both the U.S. citizen sponsor and the foreign fiancé(e) must meet certain eligibility requirements:

Intent to Marry: Both parties must have a bona fide intention to marry within 90 days of the foreign fiancé(e)’s arrival in the United States.

Legally Free to Marry: Both the U.S. citizen sponsor and the foreign fiancé(e) must be legally able to marry. This means any previous marriages must have been legally terminated through divorce, annulment, or death.

Met in Person: The couple must have met in person at least once within the two years preceding the filing of the K-1 visa petition, unless a waiver is granted due to extreme hardship or cultural/social norms.

Application Process

The application process for a K-1 visa involves several steps, beginning with the U.S. citizen sponsor filing a petition on behalf of their foreign fiancé(e):

File Form I-129F: The U.S. citizen sponsor must file Form I-129F, Petition for Alien Fiancé(e), with the U.S. Citizenship and Immigration Services (USCIS). This form establishes the relationship and intent to marry.

Approval of Petition: Once USCIS approves the petition, it is forwarded to the National Visa Center (NVC), which then sends it to the appropriate U.S. Embassy or Consulate in the foreign fiancé(e)’s country.

Apply for Visa: The foreign fiancé(e) applies for the K-1 visa at the U.S. Embassy or Consulate. This includes submitting Form DS-160, Online Nonimmigrant Visa Application, paying the visa fee, and scheduling an interview.

Medical Examination: The foreign fiancé(e) must undergo a medical examination by an approved physician.

Visa Interview: The foreign fiancé(e) attends a visa interview at the U.S. Embassy or Consulate. During the interview, the consular officer will assess the bona fides of the relationship and ensure all eligibility requirements are met.

Visa Issuance: If the visa is approved, the foreign fiancé(e) receives the K-1 visa, allowing entry to the United States.

After Arrival in the United States

Upon arrival in the United States, the foreign fiancé(e) must marry the U.S. citizen sponsor within 90 days. Failure to marry within this period may result in the foreign fiancé(e) having to leave the country. Here are the subsequent steps:

Marriage: The couple must marry within the 90-day period. The marriage should be documented through an official marriage certificate.

Adjustment of Status: After the marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident (LPR) by filing Form I-485, Application to Register Permanent Residence or Adjust Status, with USCIS.

Employment Authorization and Travel Permit: The foreign spouse can also apply for employment authorization (Form I-765) and a travel permit (Form I-131) while the adjustment of status application is pending.

Important Considerations

Validity of the K-1 Visa: The K-1 visa is a single-entry visa, valid for a period of six months. The foreign fiancé(e) must enter the U.S. within this period and marry the U.S. citizen sponsor within 90 days of arrival.

Dependents: Children of the foreign fiancé(e) under the age of 21 may be eligible for K-2 visas, allowing them to accompany their parent to the United States.

Fraud and Misrepresentation: USCIS and consular officers are vigilant in detecting fraudulent relationships. Providing false information or misrepresenting the relationship can lead to visa denial and other legal consequences.

Change of Status: If the marriage does not occur within 90 days, the foreign fiancé(e) must leave the United States. Failure to depart may result in removal proceedings and impact future visa applications.
